BurnLog - AI Food Tracker & Fasting

Please read these Terms of Use carefully before downloading or
using BurnLog. By downloading, installing, or using the App,
you agree to be bound by these Terms. If you do not agree,
do not use the App.

1. Definitions

- **App** means the BurnLog mobile application available on the
Apple App Store and Google Play Store.
- **We, Us, or Our** means the developer and publisher of BurnLog.
- **You** means the individual downloading, installing, or using
the App.
- **Device** means the mobile device on which you install and
use the App.
- **AI Analysis** means the food macro and calorie estimation
feature powered by OpenAI's API.
- **Local Data** means all information you enter into the App
that is stored exclusively on your Device.

2. Acceptance of Terms

By downloading or using BurnLog, you confirm that:

- You are at least 13 years of age
- You have read and agree to these Terms of Use
- You have read and agree to our Privacy Policy
- If you are between 13 and 17 years old, you have obtained
consent from a parent or legal guardian

If you do not meet these requirements, you must not use the App.

3. License to Use

We grant you a personal, non-exclusive, non-transferable,
revocable license to use BurnLog on any Device you own or
control, solely for your personal, non-commercial purposes,
subject to these Terms.

You may not:

- Copy, modify, or distribute the App or any part of it
- Reverse engineer, decompile, or disassemble the App
- Use the App for any unlawful or unauthorised purpose
- Sell, resell, sublicense, or commercially exploit the App
or its features
- Attempt to extract the source code of the App
- Use automated tools to interact with the App

4. One-Time Purchase

BurnLog is available as a one-time purchase through the Apple
App Store or Google Play Store. There are no subscriptions,
recurring charges, or in-app purchases.

- Payment is processed entirely by Apple or Google
- All sales are final and subject to the refund policies of
Apple and Google respectively
- We do not process, store, or have access to any payment
information
- Your purchase grants you a license to use the App as
described in Section 3

For refund requests, please contact Apple Support or Google
Play Support directly.

5. Health and Medical Disclaimer

**BurnLog is not a medical application and does not provide
medical advice.**

All calorie estimates, macro calculations, nutritional
information, health scores, fasting state descriptions, and
any other health-related information provided by the App are
for general informational and wellness purposes only. They are
not intended to substitute for professional medical advice,
diagnosis, or treatment.

Specifically:

- Calorie and macro estimates generated by AI analysis are
approximations only and may be inaccurate
- Fasting state descriptions (e.g. ketosis, fat burning) are
general educational information, not medical assessments
- Health scores are algorithmic estimates, not clinical
evaluations
- Weight tracking and BMI calculations are informational only
- Step counts and calorie burn estimates are approximations

**Always consult a qualified healthcare professional before
making changes to your diet, fasting routine, or exercise
programme, particularly if you have any medical conditions
or are pregnant.**

We are not liable for any health outcomes, injuries, or
adverse effects resulting from your use of the App or
reliance on its outputs.

6. AI Food Analysis

BurnLog uses OpenAI's API to analyse food photos and text
descriptions to estimate calories, macros, and health scores.

You acknowledge that:

- AI-generated nutritional estimates are approximations and
may contain errors
- Results may vary based on photo quality, portion sizes,
food presentation, and other factors
- We make no guarantees regarding the accuracy of AI-generated
nutritional data
- Food images or descriptions you submit for analysis are sent
to OpenAI's API and are subject to OpenAI's Terms of Service
and Privacy Policy
- We do not store, log, or access your food images or analysis
results on our servers

7. Apple Health and Google Fit Integration

BurnLog may request access to read step count and activity data
from Apple Health (iOS) or Google Fit (Android). By granting
this permission, you acknowledge that:

- You are granting BurnLog read-only access to the selected
health data categories
- This data is displayed within the App only and is not
transmitted to our servers
- You can revoke this permission at any time through your
device settings
- We are not responsible for inaccuracies in data sourced
from Apple Health or Google Fit

8. Your Data and Local Storage

All data you enter into BurnLog — including your profile, food
logs, fasting history, weight entries, and other health
information — is stored exclusively on your Device.

You acknowledge that:

- You are solely responsible for maintaining and backing up
your Local Data
- Uninstalling the App will permanently delete all Local Data
- We cannot recover lost data as we do not store it
- Device loss, damage, or failure may result in permanent loss
of your data
- We have no liability for any loss of Local Data

9. Biometric Authentication

BurnLog uses your device's biometric authentication system
(Face ID or Touch ID) to protect access to the App. By
enabling this feature, you acknowledge that:

- Biometric authentication is managed entirely by your
device's operating system
- We do not access, store, or process any biometric data
- You are responsible for managing biometric access on
your device

10. Intellectual Property

All intellectual property rights in BurnLog — including but
not limited to the App design, interface, graphics, icons,
logos, text, and underlying software — are owned exclusively
by us or our licensors.

Nothing in these Terms transfers any intellectual property
rights to you. Your license to use the App does not include
any right to use our branding, trademarks, or intellectual
property for any other purpose.

11. Prohibited Conduct

When using BurnLog, you agree not to:

- Use the App for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorised access to any part of the App
- Interfere with or disrupt the operation of the App
- Use the App in any way that could damage, disable, or
impair the App
- Attempt to reverse engineer, decompile, or extract source
code from the App
- Use the App to transmit any malicious code or harmful content
- Violate any applicable laws or regulations in connection
with your use of the App

12. Third-Party Services

BurnLog integrates with the following third-party services:

- **OpenAI** — for AI-powered food analysis
- **Apple Health** — for step and activity data (iOS)
- **Google Fit** — for step and activity data (Android)
- **Apple App Store** — for payment processing (iOS)
- **Google Play Store** — for payment processing (Android)

These services are governed by their own terms of service and
privacy policies. We are not responsible for the practices,
content, or availability of any third-party services. Your
use of these services is at your own risk.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL
WARRANTIES INCLUDING BUT NOT LIMITED TO:

- Warranties of merchantability or fitness for a particular
purpose
- Warranties that the App will be uninterrupted, error-free,
or secure
- Warranties regarding the accuracy of AI-generated
nutritional data
- Warranties that defects will be corrected

YOUR USE OF THE APP IS ENTIRELY AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL
NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF
OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE
AMOUNT YOU PAID FOR THE APP.

THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER BASED ON
WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND
WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES.

15. Indemnification

You agree to indemnify, defend, and hold us harmless from
and against any claims, liabilities, damages, losses, and
expenses — including reasonable legal fees — arising out of
or in any way connected with:

- Your use of or access to the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any inaccuracy in information you provide through the App

16. Children's Privacy

The App is not intended for children under the age of 13.
We do not knowingly collect any personal information from
children under 13. If you become aware that a child under
13 has used the App, please contact us at
support@burnlog.app.

17. Updates and Changes to the App

We may from time to time release updates to the App to
improve functionality, fix bugs, or add new features.
Updates may be distributed through the Apple App Store or
Google Play Store. We recommend keeping the App updated
to the latest version.

We reserve the right to modify, suspend, or discontinue
the App or any part of it at any time without notice.
We shall not be liable to you or any third party for any
modification, suspension, or discontinuation of the App.

18. Changes to These Terms

We may update these Terms of Use from time to time. When
we do, we will update the "Last Updated" date at the top
of this document. Your continued use of the App after
any changes constitutes your acceptance of the updated
Terms.

We encourage you to review these Terms periodically.

19. Governing Law

These Terms are governed by and construed in accordance
with applicable law. Any disputes arising from these Terms
or your use of the App shall be subject to the exclusive
jurisdiction of the courts in the relevant jurisdiction.

20. Severability

If any provision of these Terms is found to be
unenforceable or invalid, that provision will be limited
or eliminated to the minimum extent necessary, and the
remaining provisions will continue in full force and effect.

21. Entire Agreement

These Terms of Use, together with our Privacy Policy,
constitute the entire agreement between you and us
regarding your use of BurnLog and supersede all prior
agreements, understandings, or representations.
